The lies Labour in meltdown: Part one IT WAS all so simple. Wendy Alexander had tied up Labour's Holyrood leadership without being challenged; it was a coronation rather than a contest. She succeeded Jack McConnell in September without breaking sweat. But the Paisley North MSP, ever the strategist, had a plan if she had faced a contest. Thus she set up the "Wendy Alexander Campaign" in August, a body to attract donations from supporters. Around £16,600 was raised in the end, cash that was used to fund a "tour" rather than a battle against a colleague.

Three months later, Alexander's leadership is a heartbeat away from having its life support machine switched off. She and her campaign lieutenants are at the centre of allegations of "donor switching" and of misleading the Electoral Commission, following an investigation by the Sunday Herald.
Alexander's team is facing damaging charges that its members knew her campaign donation from tax exile Paul Green was suspect three weeks ago. According to her secret list of donors, of which the Sunday Herald has a hard copy, Green's cash was flagged up as being questionable as early as November 5. The document was created on a computer registered to "Brian Ashcroft", Alexander's husband.
This contradicts the claim made by Tom McCabe - Alexander's campaign manager - that she was made aware of a personal, rather than corporate, donation from Green last Thursday.
The meltdown of Alexander's leadership follows publication of two stories broken last month by this newspaper.
The first revealed how Alexander's leadership campaign had dodged declaration rules by attracting donations for £995 - a fiver less than the amount that needs to be registered.
This was followed by a second article, that outlined how the new Holyrood leader had accepted a donation from a tax exile living in the Channel Islands - a practice outlawed by her Labour colleagues at Westminster.
The reaction of David Whitton, a key Alexander ally and temporary press spokesman, was telling. He refused to deny the story, declined to name the tax exile, and instead stuck to the line that Electoral Commission rules had been "complied" with.
The story went nuclear last Thursday. The mystery tycoon was unmasked as Paul Green, a Jersey-based tycoon with business interests in the Isle of Man. Cash from such an individual, who is not entitled to vote in UK elections, is illegal under electoral law. The same day witnessed some of the most shambolic scenes ever seen at Holyrood. Whitton had tried to explain the donation by claiming it had been made by Green through a UK company, Combined Property Services (CPS). However, this was quickly denied by CPS managing director Gordon Wilson, who said Green was merely a "client" of his firm, which had not made any contribution to Alexander's campaign.
As news filtered out about CPS's non-donation, Alexander put in a shockingly bad performance at First Minister's Questions, followed by her getting chased down the stairs by a pack of journalists eager for answers. None were provided.
Whitton then found himself surrounded by the same media scrum, during which he failed to offer any explanation for Green's donation, or the CPS denial. The story was falling apart.
A press conference was arranged for 2pm, at which the media were told Labour MSP Charlie Gordon, the MSP who had organised the Green donation, would make a statement, followed by campaign manager McCabe.
Gordon told onlookers he had believed the Green donation was made through CPS, an assumption he now said was "wrong". He tendered his resignation as transport spokesman, and apologised to Alexander and Green.
The Glasgow Cathcart MSP's admission was followed by McCabe laying the blame at Gordon's feet.
However, the Sunday Herald has evidence in its possession that seriously challenges McCabe's claim that only Gordon knew of the tax exile's personal, and illegal, contribution.
Three of McCabe's comments give an appropriate context to the conspiracy to cover up Green's donation.
Asked at the press conference when Alexander first knew the donation had been made from Green, rather than CPS, he said: "Wendy always understood that money came from the company. When Mr Gordon explained to us the assumptions he had made at one o'clock today it was clear to us that a donation was not appropriate."
Asked on the BBC's Newsnight later about Green, McCabe said: "I couldn't have told you where he lived."
Asked by the Sunday Herald on November 17 whether Alexander had received a donation from a tax exile, he said: "That's the first I've heard of that."
However, the Sunday Herald has obtained a printed copy of Alexander's full list of secret donors, which names each contributor, how much was given, as well as the campaign member from whom it was solicited.
According to the "properties" tab in the Microsoft Word document, "Brian Ashcroft", Alexander's husband, is named as the "author". This means the document was created on a computer registered in his name.
The secret list, which has never been published before, states under the "donor" heading that Paul Green had made a donation of £950. No mention of CPS. The column marked "Name/ address for Elect Comm purpose" contained Green's Jersey address.
Crucially, the list also drew attention to the donation's illegality by stating at the end: "Permissible?" According to the word file on which it was saved, the document's date is November 5.
Days later, the Wendy Alexander Campaign informed the Electoral Commission that it had, in fact, received the donation from CPS. The details had been changed. Alexander's campaign team had information over three weeks ago that Green's donation was suspect.
At a time when there had been no press coverage of the subject, the team informed the Electoral Commission that the donation had come from CPS.
If the campaign had believed on November 5 that the Green donation was made through a UK-based company, why was the legality of the contribution questioned on its own list? And why was Green's Jersey address named as the contact detail?
Green's own interventions also implicate Alexander. He hit out at Labour for repeatedly dragging CPS into the mess, while making it clear that Alexander had sent him a letter to his Jersey address thanking him for the money.
In the light of such revelations, McCabe's insistence that Alexander, or anyone else, was only aware last week that the Green cash had come from him personally is open to question. A document created on Brian Ashcroft's computer suggests otherwise.
(Incidentally, the same list reveals a separate donation from a "PG other" for £995. The "banking section" column, however, states: "NO/REMOVE.")
This is not the only "donor switching" row evident on the secret Labour list.
According to the Ashcroft document, one of the names in the "donor" section is Moir Lockhead, the chief executive of transport giant First Group, who was said to have contributed £995.
In the category marked "name/address for Elect Comm purpose", the name is switched from Lockhead to John Lyons, the former Labour MP. The cash, as stated on the list, was "on way via John Lyons". A spokesman for Lockhead denied he had made any contribution.
The bizarre "donor switching" is just one part of the campaign team's questionable fund-raising practices. Alexander's allies solicited donations that fell £5 under the level for public declaration, and made sure money was sent to the Campaign, not the MSP, to allow her to avoid registration at Holyrood.
As well as an Electoral Commission probe, Alexander could face a police inquiry after her team admitted to flouting the law. Pundits and MSPs are questioning whether the daily drip of revelations will make her Labour's shortest-serving leader.
During her leadership contest, Alexander spoke of her Labour "values" and called on colleagues to re-connect with voters. It is difficult to match her words with the deeds of taking cash from a tax exile, switching donors, and soliciting donations to avoid public disclosure.

Good god, this is sensational stuff, Alexander, McCabe and the rest of the old guard are surely finished. It is actually at the point where Scottish Labour can be damaged no further so great is the damage thus far.
In some ways this is a cleansing process that Scottish Labour has to go through. What kind of party will emerge at the other end will define U.K. and Scottish politics for generations, assuming the U.K. remains intact.
Will they shake themselves loose of London Labour and the careerists that have been the catalyst for this disintegration?.....

It proves that Gordon and others fabricated information to be passed on to the Electoral Commission. It proves that Alexander made a false statement in Parliament.

Suppose someone better ask, how did the Herald get hold of one of Mr Ashcroft's personal computer files in printed form and who got to access it in the first place? I mean, a word document just doesn't print off anything you haven't typed into it. It won't tell you the owner of the computer so why not just let the whole rancid bunch of cats out the bag Herald?

We may well see the return of Jack MacConell as an interim leader. He has a profile, is a safe pair of hands and knows the ropes. Scottish Labour are in no position now to oppose the SNP, it is a case of plugging the leaks on the sinking ship and guiding her into the harbour for repairs.
In the longer term, who knows who will lead. Perhaps a resignation from a safe seat allowing a big name to step in?

McCabe was bound to have been involved in such murky dealings. In many ways he representsa much is what is bad and rotten about politics in Scotland.

After reading this piece of investigative journalism and the actions and statements of Wendy Alexander, Tom MCabe, and Charles Gordon it is astounding how they have not thrown the towel in a resigned as MSP's to give the electorate the opportunity to pass judgement on these despicable people who are supposed to be legislators.
Let us hope that their writ does not run to influencing the Procurator Fiscal and the Police - but unfortunately it may as events down south have already shown.
Get them charged by the police and let us clear the stable of the excrement that puts poison at the heart of democracy.
If they are not charged then what this says is that crime is all right for the boys at the top and that we have a corrupt prosecutors and police who will not uphold the law.

Well at least going by this we know one of two people have to have stitched her up either the nanny or the hubby. Maybe the prof has been getting his own back for sleeping on the couch over the whole independence is better than federalism thing he said.

I can create a word document and make the author King Kong. does that really make him the writer of that docuement. Not a lover of labour but relying on a document like that is sort of flimsy. Must be someone in the know typing up the doc and pinning it on him indoors..

The real question now is how the Electoral Commission and the police handle this matter. If you are an election agent at whatever level you have to be most careful to get everything right, and you have to be very aware of the fact that you are held responsible for any act by any person which can be pinned on the party you represent by your opposition. The authorities are very strict about the upholding of electoral law.
The question is, to what extent will that apply to the high heid yins o' the labour party. I consider it of the greatest importance that the letter of the law is adhered to in this case. There have been too many instances in the south over the last few years where the outcome of various "inquiries" have been, to say the least, somewhat lacking in credibility. To have that sort of thing happen in this case would do neither the credibility of the authorities and the Scottish legal process, nor the political environment as a whole, the leasts good.
And that would be to nobody's benifit.....except possibly to the benifit of these who least deserve it.

The question is, to what extent will that apply to the high heid yins o' the labour party. I consider it of the greatest importance that the letter of the law is adhered to in this case. There have been too many instances in the south over the last few years where the outcome of various "inquiries" have been, to say the least, somewhat lacking in credibility. To have that sort of thing happen in this case would do neither the credibility of the authorities and the Scottish legal process, nor the political environment as a whole, the leasts good.
And that would be to nobody's benifit.....except possibly to the benifit of these who least deserve it.

Well I believe Wendy should be awarded the Golden Rose of Montreux for all laughs she has given me over the last few weeks. But these latest revelations have stopped me laughing and I am now just saddened and stunned at the sheer contempt she and her gang have for your wonderful Nation.

I proposed yesterday, and I continue to propose today, that the best way to handle this is to write or E-mail the Presiding Officer and Parliamentary Standards Officer requesting the suspension of McCabe, Alexander, Gordon and Whitton from the parliament building at Holyrood until such time as the police have completed their investigations (which shouldn't be hard as all of them have admitted in public they broke the law).
It sends the best message from the people of Scotland that no matter what party, we have had enough of not holding our politicians accountable.
By doing so we start playing a new game which is called "The people of Scotland hold their sovereignty dear". The main rule of the game is: "We do not let any political party away with acts that damage the integrity or probity of Parliament at Holyrood."
So we stop muttering into our porridge on this or the Herald blog and E-mail the Presiding Officer and Parliamentary Standards Officer making our views known (politely, please Flab skin et al.).
You want to create a different parliament or Scotland then take action. Real influence is only an E-mail away!

It would only take a forwarded email attachment (to e.g. The Herald) to put it in the public domain.

They live in a bubble where failure of a project is accepted and another role is found for them and this fiasco is the outcome of years of systemic failure to accept responsibility and so resignations will not happen.
Good work on The Herald's part but it does seem to a bit of a late conversion as Scottish political journalists know plenty about the kind of **** that's gone on in Scottish public life for years but to keep their contacts sweet have taken a very soft line indeed.

I can't but help think that if it was Alex Salmond who'd accepted an illegal donation that the media would be 100% more hostile...

If Wendy Alexander were to take the rightful course and resign now, it would turn up the wattage on the corruption spotlight focused on Maggie Broon in England.
She is of course finished as a politician in Scotland.
I wouldn't be surprised if there is a deal already in place which will ensure Wendy Alexander of some reward (to be made at some point in the future) in return for her not causing more sensational headlines against Broon by resigning immediately.
This "reward" will take the form of a package deal which will include "lightening" or even covering up the criminal charges which she now faces, plus..... some nice fat sinecure.
She is, after all, a career politician who cares nothing about Paisley or Scotland.
If the "deal is not already in place then it is most probably being "negotiated" at this very moment, with her "big pal" Maggie Broon.
Her leverage will include her "knowledge" of other unsavoury items which Maggie Broon would rather keep quiet.
At least for now.

If this had been the SNP we would be getting bulletins on the BBC every half hour and the whole cabinet would be in jail but because its new Labour and this is what new Labour do and have done for years it is treated differently.
If it has been proved that they fought the election on "dirty money" then every one of them should resign their seat and fight again.If the SNP can pull off what they done in May against a hostile press and a right wing Labour party backed by dodgy money then what would have happend had it been a level playing field.

The BBC's news web site, Scottish section, has been updated at 09:37 this morning. The 'Wendygate' story is still not deemed important enough to appear on the main Scottish news page. It is not even the main story in the politics section. To me, this decision by the BBC editor will itself become a story.
The SNP working with the Tories at local Government is still there though.

Congratulations on a superb bit of investigative journalism, something so sadly lacking on the East Coast with the cringingly Labour-sycophantic 'Hootsmon' and stablemate, the 'Edinburgh Evening Chip-Wrapper'.
Of course, another 'little local difficulty' for the Labour Party blundering ever-deeper into this swamp is that they are no longer synonymous with the Scottish Executive/Government
. They can't rely on the Government smoke'n mirrors Dept. and their 'spinners'; Whitton, McCabe, Gordon, Wendy et al, are being exposed for the incompetent, blustering stairheid bullies they really are. Very Satisfactory!

I do think that these underhand dealings are shocking and should be dealt with at the highest level. However I hope it does not lead to Wendy Alexander losing her position.....with her in charge of the main opposition party to the SNP, Independence should be that step closer!!

The author properties of a Word document will generally show the originator of any file, but not in all cases. A completely innocent list of donors could have been created by Brian Ashcroft, and then added to by any random Labour minion. The properties would still show Ashcroft as the author. If you're going to reveal the smoking gun, at least make sure you know what you're talking about.
