US Army in Copyright Investigation over Harry Potter ‘Spoof’

Introduction

A Harry Potter lookalikes comic published by the US Army is currently under investigation by representatives of author JK Rowling. The comic, titled Preventative Maintenance (or PS) Monthly, features characters with striking similarities to the actors who portray Rowling’s creations in the film adaptations of her books. This investigation has raised concerns about potential copyright infringement and the protection of intellectual property rights.

Rowling and Warner Bros Respond

A spokeswoman for film-maker Warner Bros expressed the value they place on intellectual property rights and stated that they aim to protect those rights. Similarly, a spokesman for Rowling confirmed that they are currently looking into the matter. It is worth noting that the US Army has not approached either Rowling or Warner Bros for any copyright use.

The Comic Strips

The cartoon strips within Preventative Maintenance Monthly depict the character Sergeant Half-Mast, who closely resembles the regular hero of preventative maintenance. He is seen arriving at Mogmarts School of Magical PM in a Humvee, being greeted by Professor Rumble-Doore, and participating in a lesson about the correct storage of potions. These scenarios bear a parallel to the Harry Potter films where Harry arrives at Hogwarts school in an Anglia car and is greeted by Professor Dumbledore.

Additionally, one of the characters in the comic strip, Professor Snappy, bears a striking resemblance to actor Alan Rickman, known for his portrayal of Professor Snape in the Harry Potter films. Another character, Topper, shares physical attributes similar to Harry Potter in the books, such as floppy hair and rimmed glasses. Professor McDonagal is also featured, teaching Wand PM with guidance on proper wand maintenance.

Parody or Copyright Infringement?

Preventative Maintenance Monthly has been a long-standing army tradition for over 50 years. The editor of the comic defends the use of these characters, stating that they were not copied from the Harry Potter series, but rather created by a contracted artist. The intention behind featuring familiar characters is to encourage soldiers to engage with the publication.

On the other hand, representatives of JK Rowling argue that the use of these characters in a military publication could potentially infringe upon her copyrighted work. While parody is protected under the first amendment in the US, courts have typically upheld parodies that have an educational purpose. It remains to be seen whether the comic published by the US Army falls within the scope of parody or if it crosses the line into copyright infringement.

Rowling's Stance on Copyright

JK Rowling has a history of actively protecting her intellectual property rights. In the past, she has pursued legal action against parties that have leaked details of her books or produced unauthorized translations. Her website also advises fans to avoid purchasing fake e-book versions of her books. Rowling's vigilant approach to copyright protection suggests that she is likely to take any potential infringement seriously.

The Importance of Intellectual Property

Intellectual property rights are crucial in protecting the creations and innovations of individuals and businesses. This case involving the US Army and JK Rowling highlights the need for awareness and respect for these rights. As technology advances and digital media becomes more prevalent, it becomes increasingly important to uphold and enforce intellectual property laws to protect the rights of creative individuals.
